Privacy Statement Jaga Home |
The collection and processing of personal data is inherent to the use of the Jaga Home app. If you do not wish to provide any personal data, you will not be able to use the app.
Your trust in us is the most important asset of Jaga (hereinafter referred to as "Jaga", "we" or "us") and your privacy is therefore essential to us. This privacy statement (hereinafter referred to as the "Privacy Statement") applies to all (commercial) relationships between Jaga and its customers, prospects and business partners within the framework of our app, Jaga Home (hereinafter referred to as the "App").
Jaga wishes to emphasise that it endeavours at all times to act in accordance with (i) the Belgian Act of 30 July 2018 on the protection of individuals with regard to the processing of personal data and/or (ii) the EU Regulation of 2016 on the protection of individuals with regard to the processing of personal data relating to the free movement of such data and repealing Directive 95/46/EC (hereinafter referred to as "Privacy Legislation"). This Privacy Statement contains, among other things, information about the personal data that Jaga collects, as well as about the way in which Jaga uses and processes these personal data.
The use of the App or of one or more services offered by Jaga affiliated with the App implies your explicit approval (by means of communication of your personal data or opt-in) of the Privacy Statement and thus of the way in which we collect, use and process your personal data.
Please read this Privacy Statement in conjunction with the Terms of use of the App.
For the development and use of the App, Jaga relies on Wisemen a company under Belgian law with registered office at Watertorenstraat 2, 3590 Diepenbeek, Belgium (hereinafter referred to as "Wisemen"). Jaga is the data controller and shall have exclusive access to and control over the personal data. Accordingly, Jaga is authorized to process the collected personal data and shall bear full responsibility for such processing in compliance with all applicable data protection laws and regulations. Wisemen, acting solely in the capacity of a data processor, is engaged to provide support services in relation to the processing. Under no circumstances shall Wisemen exercise any independent decision-making authority or control over the personal data.
- Types of (personal) data
Jaga may collect and process the following (personal) data:
ü Name;
ü First name;
ü E-mail address;
ü Preferred language;
ü Preferences of the equipment linked to the App;
ü Properties of the device on which the App will be installed (such as type, operating system, etc.);
ü IP address;
ü Measuring data, see the functionalities of the respective equipment (such as, but not limited to room temperature, holiday mode of the system, etc.)
- Mode of collection of personal data
These personal data are collected from and within the framework of, respectively:
ü Creating an account in the App;
ü Login to the account in the App;
ü The use of the devices linked to the App.
By installing and/or using the App, you therefore expressly (and voluntarily) consent to the collection and processing of personal data by the Jaga and Wisemen.
- Use of personal data
Jaga may use your personal data for:
ü The creation of an account;
ü The implementation of the agreement;
ü The optimisation of the App;
ü Offering customer service;
ü Troubleshooting;
ü Making the equipment settings more energy efficient;
ü Composing a user profile;
ü Statistical purposes.
The processing of your personal data takes place on the following legal grounds, on a case by case basis:
- The processing is necessary for the implementation of the agreement relating to the use of the Jaga Home App;
- You have given your consent to the processing of your personal data for one or more specific purposes. Where necessary, we will therefore ask for your express consent to the use of the personal data.
- Transfer of personal data to third parties
Jaga will not pass on your personal data to third parties, unless it is necessary in order to provide a service to you. If it is necessary for Jaga to disclose your personal data to third parties in this context, the third party in question is obliged to use your personal data in accordance with the provisions of this Privacy Statement and of the data processing agreement concluded with Jaga.
For example, Jaga relies on Wisemen for the development and use of the App, and the App is hosted by servers within the European Union.
However, without prejudice to the above, Jaga may disclose your personal data to the competent authorities (i) where Jaga is obliged to do so by law or in the context of judicial or future legal proceedings and (ii) to safeguard and defend our rights.
Jaga will not sell, rent or transfer your personal data to third parties, unless it has concluded a data processing agreement with the third party in question, which includes the necessary guarantees regarding confidentiality and protection of your personal data.
- Storage of personal data
Unless a longer retention period is required or justified (i) by law or (ii) for compliance with another legal obligation, Jaga will, in principle, retain your personal data for a period equal to the term of the agreement, subject to observance of a time limit for administrative processing for the removal of the personal data.
However, the measurement data are stored for 3 years after collection.
This period is normally necessary for achieving and fulfilling the objectives as described in the Privacy Statement under 'Use of personal data'.
However, Jaga undertakes to apply shorter retention periods where the above retention periods are not required.
- Your privacy rights
If you wish to exercise your privacy rights, as defined by law and listed below, please contact privacy@jaga.be or fill in the form to exercise your privacy rights and send it to us by email or post (Jaga, Verbindingslaan 16, 3590 Diepenbeek, Belgium):
ü Right of access to the personal data that Jaga holds about you;
ü Right of rectification, completion or update of your personal data: you can exercise these rights yourself at any time in the App;
ü Right to be forgotten;
ü Right to restrict the processing of your personal data;
ü Right to transfer your personal data;
ü Right of objection/reaction to the processing of your personal data.
In principle, you can exercise these rights free of charge. We will respond within one month to your request to exercise your privacy rights. Please note that you may need to confirm your identity in order to grant your request.
If you no longer wish to receive newsletters or information about our services, you can unsubscribe at any time by clicking on the "unsubscribe" button provided at the bottom of every e-mail from Jaga.
- Security of personal data
Jaga undertakes to take reasonable, physical, technological and organisational precautions to prevent (i) unauthorised access to your personal data, as well as (ii) loss, misuse or unauthorised modification of your personal data.
Notwithstanding Jaga's safety policy, the controls it carries out and the actions it takes within this framework, an infallible level of safety cannot be guaranteed. No method of transfer or transmission via the Internet or any method of electronic storage is 100% secure, therefore Jaga cannot guarantee absolute security in this respect.
More specifically, Jaga and Wisemen take the following security measures, among others, to limit misuse of and unauthorised access to personal data:
ü logical access control, using passwords;
ü automatic logging of all actions concerning the personal data;
ü encryption of digital files containing personal data;
ü encryption of passwords;
ü securing network connections via Secure Socket Layer (SSL) technology;
ü targeted access restrictions;
ü control of authorisations granted.
- Cross-border processing of personal data
All personal data collected by Jaga will only be stored and processed in Belgium or another EU member state.
Jaga will have all personal data it has collected stored via Wisemen on a secure server in the European Union.
There is therefore no transfer or processing of your personal data outside the European Union.
- Update Privacy Statement
Jaga reserves the right to update this Privacy Statement by posting a new version in the App. In this context, it is strongly recommended that you regularly consult the App and the relevant page on which the Privacy Statement is displayed to ensure that you are aware of any changes.
- Other websites
The App may contain hyperlinks to other websites. Under no circumstances is Jaga responsible for the privacy policies or practices of any third party.
- Complaints
If you have complaints about the way in which Jaga collects, uses and/or processes your personal data, you can submit a complaint to the Data Protection Authority (www.gegevensbeschermingsautoriteit.be).
